Dumpster Rental Terms & Conditions (Booking Agreement)
We believe in clear pricing and no surprises. These terms are here to protect both you and us, and to make sure your job goes smoothly from delivery to pickup. Most customers never encounter an issue — but when something comes up, this agreement makes sure everyone knows exactly where they stand.
By booking, signing electronically, or accepting delivery, you agree to this Agreement and authorize Haul-My-Mess.com to charge your payment method on file for any applicable overages or additional fees.
Important: If you are unsure what material type you have, call or text us first at (216) 799-9911. We will help you choose the correct dumpster size and avoid extra charges.
⚖️ 1. Weight Allowances & Overage Charges
Your rental includes disposal up to the weight allowance for the dumpster size booked. If your load exceeds the included allowance, overage charges apply. Weight is determined by certified landfill/transfer station scale tickets — documentation available upon request.

Heavy/dense materials (concrete, dirt, brick, roofing, tile) are subject to separate pricing due to landfill surcharges. Call to confirm rates before loading.
📦 2. Rental Period & Extensions
- Standard retail rental includes 7 calendar days unless otherwise specified at checkout.
- Additional days are billed at $15 per day. Rental terms are not prorated.
- If the dumpster is not picked up within 30 days of delivery and Customer has not responded to retrieval notices, Haul-My-Mess.com reserves the right to retrieve the container without further notice. All accrued daily fees and retrieval costs remain the Customer's responsibility.
- Customer is responsible for any municipal permit fees or violations that accrue during the rental period.
📅 3. Pickup Scheduling (Pickup is NOT Automatic)
Pickup is never automatic. You must actively schedule your pickup or daily fees continue to accrue.
- You must call or text (216) 799-9911 at least 24 hours in advance to schedule pickup.
- Dumpster must be accessible and load must be at or below the rim at pickup time.
- Customer may be required to text a photo showing the load is level with or below the rim before pickup is dispatched.
🚛 4. Delivery Windows & Expedited Option
Standard deliveries are typically scheduled between 8:00 AM and 6:00 PM. Due to landfill wait times, traffic, weather, equipment issues, route changes, and unexpected jobsite conditions, exact delivery and pickup times are not guaranteed unless confirmed in writing.
Expedited Delivery ($30 add-on): Secures a confirmed 2-hour delivery window, subject to availability. Must be requested at booking.
- Expedited delivery must be requested at booking and is subject to schedule confirmation.
- If Haul-My-Mess.com arrives more than 30 minutes after the confirmed 2-hour window due solely to Company scheduling error, the $30 expedited fee will be refunded.
- To avoid expedited fees, customers may schedule delivery the prior day when possible.
🚨 5. Trip Fees & Failed Delivery/Pickup
A $175 trip fee applies in any of the following situations:
- Delivery or pickup is unsuccessful because the dumpster or access point is blocked by vehicles, equipment, low-hanging wires, or other obstructions.
- Customer is not present when presence was confirmed as required.
- The load is overfilled and cannot be legally tarped for transport.
- Access is otherwise impossible or unsafe at the driver's discretion.
- Pickup cannot be completed due to frozen or weather-affected debris that prevents safe loading or transport.
Trip fees are charged to the payment method on file and do not count toward the rental or disposal cost.
❌ 6. Cancellations & Modifications
- Cancellations or changes made at least 24 hours before delivery: no charge.
- Cancellations or changes made less than 24 hours before delivery: $125 late-change fee.
- Same-day cancellations after the driver has been dispatched: full trip fee of $175 applies.
- Refunds for unused rental days are not issued once the container has been delivered.
🚫 7. Prohibited Materials
Per federal law and Ohio EPA regulations, the following items may not be placed in any Haul-My-Mess.com container:
- Liquids, paints, or solvents; oils (motor, hydraulic, transmission)
- Batteries, aerosol cans, propane tanks, or other pressurized containers
- Chemicals, herbicides, pesticides, or fertilizers
- Tires — if tires are found in the container, a $50 per tire disposal fee will be charged to the payment method on file in addition to any other applicable fees
- Asbestos-containing materials or medical/biohazard waste
- Flammable, explosive, or radioactive materials
- Electronic waste (e-waste) or appliances containing refrigerants (unless pre-approved)
Contamination Liability: If prohibited materials are discovered at the landfill or transfer station, Customer is responsible for all resulting contamination fees, fines, remediation costs, and disposal surcharges.
Yard Waste Note: Tree stumps, branches, and grass clippings must never be mixed with other debris. A dedicated yard waste container is required.
⚠️ 8. Abandoned Load & Forced Off-Load
If a container cannot be legally or safely transported due to prohibited materials, unsafe loading, overfilling, or frozen/hazardous conditions, Haul-My-Mess.com reserves the right to:
- Refuse pickup and charge a $175 return trip fee until the load is brought into compliance.
- Off-load the container contents at the Customer's delivery site without prior notice if transport is not possible and the situation creates a legal or safety risk. Customer is responsible for all costs associated with the off-load, including labor and any disposal or remediation fees.
- Recover the container at any time if prohibited materials are identified, regardless of rental period remaining. No refund will be issued for unused rental days in this circumstance.
📏 9. Load Level Enforcement
For legal transport, all debris must be level with or below the rim of the container so the tarp can be properly secured. This is a DOT requirement — not a preference.
- Containers loaded above the rim will not be removed. The driver will leave the container on-site and a $175 trip fee will be charged.
- Customer is solely responsible for removing excess material to bring the load into compliance before a return pickup can be scheduled.
- Customer may be required to text a photo confirming the load is at or below rim level before a return trip is dispatched.
- Haul-My-Mess.com accepts no liability for project delays caused by an overfilled container that cannot be picked up.
🏠 10. Property Damage & Equipment Safety
- Driveway & Surface Damage: Haul-My-Mess.com is not responsible for damage to driveways, pavement, lawns, landscaping, irrigation, or underground utilities caused by container placement or retrieval. Placing plywood or protective boards under the container is strongly recommended.
- Placement: Drivers will not place containers in unsafe or inaccessible areas. Once placed, do not move the container. Relocation at Customer's request: $150 fee. Unauthorized movement by Customer voids liability protections and may result in additional charges.
- Loading: Do not exceed the load line (rim). Secure and close the rear door after loading. Do not force, modify, or cut the container in any way.
- No Open Burning: Burning of any materials inside or adjacent to the container is strictly prohibited and may result in immediate retrieval, full replacement cost of the container, and reporting to fire authorities.
- Equipment Damage: Customer is liable for damage to the container caused by misuse, including overloading, burning, welding, cutting, or improper loading. Repair or replacement costs will be charged to the payment method on file.
🛣️ 11. Street Placement, Permits & Right-of-Way
If Customer requests placement on a public street, sidewalk, or right-of-way:
- It is the Customer's sole responsibility to obtain any required municipal permit before delivery.
- All permit fees are the Customer's responsibility.
- Any fines, citations, or towing orders issued by a municipality are the Customer's responsibility. Haul-My-Mess.com will not be liable for fines or towing costs.
- Haul-My-Mess.com reserves the right to retrieve the container immediately if notified of a municipal order to do so. Standard trip and daily fees apply.

🔒 12. Theft, Fire & Third-Party Use of Container
- Customer assumes responsibility for the container from the time of delivery until pickup is completed.
- Customer is responsible for ensuring third parties (neighbors, contractors, passersby) do not place prohibited materials or unauthorized debris into the container.
- Haul-My-Mess.com is not responsible for theft of the container or its contents, or for fire damage caused by third parties or unknown origin. If the container is damaged or destroyed while in Customer's possession, repair or replacement costs are the Customer's responsibility.
- It is recommended that Customer secure the area around the container to prevent unauthorized access, particularly for overnight or extended rentals.
❄️ 13. Frozen, Wet & Weather-Affected Debris
Customer acknowledges that debris weight can increase significantly due to rain saturation, snow, ice, or freezing temperatures. Frozen or water-logged loads are among the most common causes of weight overages.
- Customer is fully responsible for all overage charges regardless of whether excess weight was caused by weather conditions during the rental period.
- Haul-My-Mess.com recommends covering the container during extended rentals or periods of rain or freezing weather to manage weight.
- A $175 return trip fee may apply if the load cannot be safely retrieved due to freezing.
📷 14. Photo Documentation & Evidence
Customer agrees that Haul-My-Mess.com may photograph the container, placement area, load level, and contents at any time — including at delivery, during the rental period, and at pickup — for purposes of documentation, billing verification, overfill assessment, damage records, and dispute resolution.
- Photos taken by Haul-My-Mess.com shall be considered valid evidence in any billing dispute, chargeback, or legal proceeding.
- Customer is encouraged to photograph the container and surrounding area at delivery and at the time of pickup scheduling to maintain their own documentation record.
💳 15. Payment, Billing & Chargeback Protection
- Full payment or deposit is due at time of booking unless otherwise arranged in writing.
- By booking, Customer authorizes Haul-My-Mess.com to charge the payment method on file for all fees described in this Agreement, including overages, trip fees, daily extensions, and damage costs.
- Weight overage charges will be applied within 5 business days of disposal, after scale ticket confirmation.
- If a charge is declined, Customer will be notified and must provide a valid payment method within 48 hours. Unpaid balances may be referred to collections and Customer will be responsible for all associated collection costs and reasonable attorney's fees.
- Billing disputes must be submitted in writing to mail@haulmymess.com within 10 business days of the charge. Disputes submitted after this window may not be honored.
- Chargeback Protection: Customer agrees not to initiate a chargeback or payment reversal with their bank or card issuer without first contacting Haul-My-Mess.com directly and allowing a reasonable opportunity to resolve the issue. Unauthorized chargebacks may result in additional dispute fees, referral to collections, and legal action. Haul-My-Mess.com reserves the right to present this Agreement, photographic evidence, and scale ticket documentation to the card issuer in response to any chargeback.
♻️ 16. Waste Ownership & Environmental Compliance
- Customer represents and warrants that all materials placed in the container are legally owned by Customer or that Customer has the legal right to dispose of them.
- Title and ownership of all waste materials remain with the Customer until legally transferred to a licensed disposal facility. Customer is responsible for any fines or penalties associated with improperly disposed materials traceable to their rental.
- Customer agrees to comply with all applicable federal, state (Ohio EPA), and local regulations regarding the disposal of materials placed in the container.
- In the event that any governmental authority assesses a fine or penalty against Haul-My-Mess.com arising from materials placed in the container by Customer, Customer agrees to indemnify and reimburse Haul-My-Mess.com for such costs in full.
🔍 17. Container Condition & Delivery Inspection
- Containers are provided in working condition with functional doors and structural integrity. Minor cosmetic wear (scratches, fading, surface rust) is normal and does not constitute a defect.
- Customer should inspect the container at delivery. Any pre-existing damage must be reported to Haul-My-Mess.com by calling or texting (216) 799-9911 within 2 hours of delivery. Failure to report within this window constitutes Customer's acceptance of the container in satisfactory condition.
- Damage discovered at pickup that was not reported at delivery will be presumed to have occurred during the rental period and will be the Customer's financial responsibility.
📋 18. No Warranties
Services are provided on an "as-is" and "as-available" basis. Haul-My-Mess.com makes no warranties, express or implied, including but not limited to fitness for a particular purpose or uninterrupted service. Customer acknowledges that delivery and pickup timing may vary due to operational conditions beyond Haul-My-Mess.com's control. Haul-My-Mess.com further disclaims all implied warranties of merchantability to the fullest extent permitted by Ohio law.
🤝 19. Subcontractors & Third-Party Operators
Haul-My-Mess.com may use subcontractors or third-party operators to fulfill delivery, pickup, or disposal services. All such parties are held to the same operational and safety standards outlined in this Agreement. The use of subcontractors does not alter Customer's rights or Haul-My-Mess.com's obligations under this Agreement.
🛡️ 20. Indemnification
Customer agrees to indemnify, defend, and hold harmless Haul-My-Mess.com, its owners, employees, agents, and subcontractors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) Customer's use or placement of the container; (b) materials placed in the container by Customer or any third party during the rental period; (c) injury to persons or damage to property occurring on or around the container placement site; (d) Customer's violation of any term of this Agreement; or (e) Customer's violation of any applicable law or regulation.
⚖️ 21. Limitation of Liability
To the maximum extent permitted by applicable law, Haul-My-Mess.com's total liability to Customer for any claim arising out of or relating to this Agreement or the rental services — whether in contract, tort, or otherwise — shall not exceed the total amount paid by Customer for the specific rental giving rise to the claim. In no event shall Haul-My-Mess.com be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of business opportunity, or project delays, even if advised of the possibility of such damages.
🌪️ 22. Force Majeure
Haul-My-Mess.com shall not be liable for any failure or delay in delivery, pickup, or service caused by circumstances beyond its reasonable control, including but not limited to: severe weather, road closures, natural disasters, equipment breakdown, landfill or transfer station closures, labor disputes, or government orders. In such events, Haul-My-Mess.com will make reasonable efforts to reschedule service and will communicate delays to Customer as promptly as practicable.
⚖️ 23. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of laws provisions. Any dispute arising out of or relating to this Agreement that cannot be resolved informally shall be submitted to binding arbitration administered under the rules of the American Arbitration Association (AAA) in Cuyahoga County, Ohio. The arbitrator's decision shall be final and binding. Notwithstanding the foregoing, Haul-My-Mess.com may pursue collection of unpaid balances in Cuyahoga County Small Claims Court or municipal court without first submitting to arbitration. The prevailing party in any legal proceeding arising from this Agreement shall be entitled to recover reasonable attorney's fees and court costs.
📄 24. Entire Agreement & Modifications
This Agreement constitutes the entire agreement between Customer and Haul-My-Mess.com regarding the dumpster rental and supersedes all prior communications, representations, or understandings. No modification of this Agreement is binding unless confirmed in writing by an authorized representative of Haul-My-Mess.com. Haul-My-Mess.com reserves the right to update these terms; the version in effect at the time of booking governs that rental.
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
